On April 26, 2005, Steven Betsinger filed suit suit A503121 above against D R Horton for bait and switch interest rates.  DHI promised him a low 4.625% interest rate loan to induce him into depositing $4900 into escrow.Those deposits were subject to 'forfeiture' if for any reason Betsinger failed to get approved for the loan or failed to consumate the deal.  When he went to close, the rate had jumped to 6.5%.  DHI 'forfeited' his deposit because he didn't capitulate to the onerous rate change.  See the case filing:



The Nevada Supreme Court seems to assist D R Horton's RICO schemes to sell homes





D R Horton appealed the Betsinger jury verdict which favored Betsinger.  That appeal decision is available at the lower left of this paragraph.  Within its 'reasoned' opinion Nevada's Supreme Court then completely eliminated compensatory and punitive damages against one D R Horton agent, and then reduced compensatory damages attributable to DHI Mortgage by 80%.  The 'just' court then remanded the case to the district court to recalculate punitive damages against DHI Mortgage since the compensatory award had been so drastically reduced.  This is your court paid for by your tax dollars, but working for Donald Horton who live$ in Texa$.
