The FTC is demanding production of documents on behalf of the public's interests. The questions raised include
DHI's: not allowing consumers to use realtors or other professionals when purchasing homes or negotiating financing; communications
with Engish deficient consumers; policies regarding employee compensation for referring consumers to DHI Mortgage; financial
structure regarding yield spread premiums; high number of legal and regulatory actions; targeting of particular racial and
ethnic groups; policies regarding meeting specific sales goals; procedures for informing consumers of charges related to loan
originations; etc.
FTC's Demands
The FTC's findings are that D R Horton's objections to the investigation are without basis. The FTC is currently
investigating to determine whether D R Horton has "engeged in deceptive or unfair acts or practices in or affecting commerce
in the advertisement, marketing, sale or servicing of loans"...... and also to determine whether "Commission action
to obtain monetary relief, including consumer redress, disgorgment, or civil penalties, would be in the public interest."
